These Terms of Use ("Terms") are a legal agreement between you and TCGradar ("TCGradar", "we", "us", "our"), the operator of the TCGradar website and mobile app (together, the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old (and old enough to form a binding contract, or have your parent/guardian's consent) to use the Service. By using it you confirm you meet these requirements.
TCGradar is a trading-card catalogue, collection tracker, image-recognition tool and AI condition-grading assistant. It estimates a card's identity, condition and market value from photos and third-party data. The Service is an informational and organisational tool only.
TCGradar is an independent service. We are not affiliated with, endorsed by, sponsored by, or in any way officially connected to Nintendo, The Pokémon Company, Creatures Inc., GAME FREAK Inc., Wizards of the Coast, or any other game publisher or rights holder. "Pokémon", card names, set names, logos and related imagery are trademarks and copyright of their respective owners. We are likewise not affiliated with or endorsed by PSA, Beckett (BGS), CGC, SGC or any grading authority, nor by eBay, TCGplayer, Cardmarket, Apple or Google.
Any third-party names, trademarks and card images are used solely for identification and reference (nominative use) to help you catalogue and assess cards you own. All TCGradar software, branding, text and design are owned by us or our licensors and may not be copied or reused without permission.
AI condition grades, authenticity/counterfeit assessments, and any associated reports are automated estimates generated from your photos and are provided for guidance and indicative purposes only. They are not:
Grades and assessments are inherently uncertain, may be inaccurate, and can differ materially from professional results. You must not rely on them for buying, selling, insuring, grading or any financial decision. You use them entirely at your own risk.
Estimated values are derived from third-party sources (e.g. eBay sold listings, TCGplayer and Cardmarket data) and currency conversions, and are indicative estimates only — not guaranteed sale prices, valuations or appraisals. Card values are volatile and may be inaccurate or out of date. Nothing in the Service is financial, investment, tax or trading advice. Any decision you make is your own responsibility.
You are responsible for your account, for keeping your login secure, and for activity under it. Tell us promptly of any unauthorised use. You agree the information you provide is accurate.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you normally have 14 days to cancel a purchase of digital content. By purchasing and using credits or subscription access immediately, you request immediate supply and acknowledge that you lose the 14-day right to cancel once the digital content/credits have been used. Refund requests for app-store purchases are handled by Apple or Google under their policies. Nothing here affects your non-excludable statutory rights, including under the Consumer Rights Act 2015.
You agree not to: misuse, overload, scrape or reverse-engineer the Service; resell or redistribute it or its data; upload unlawful, infringing or harmful content; attempt to bypass scan limits, authentication or security; or use it other than for your own lawful, personal card-collecting purposes.
You keep ownership of the photos and data you submit. You grant us a non-exclusive, worldwide licence to host, process and display that content solely to operate the Service for you — including sending card images to our AI provider (OpenAI) to generate grading reports, as described in the Privacy Policy. You confirm you have the right to submit the content you upload.
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, conditions and representations not expressly stated — including as to accuracy, reliability, fitness for a particular purpose, or uninterrupted/error-free operation. We do not warrant that grades, values, recognition results or data are accurate or complete.
Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be limited or excluded under applicable law (including your statutory consumer rights).
Subject to that, and to the fullest extent permitted by law: (a) we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, goodwill, or loss arising from reliance on AI grades, authenticity assessments or estimated values; and (b) our total aggregate liability arising out of or in connection with the Service is limited to the greater of (i) the amount you paid us for the Service in the 12 months before the claim, or (ii) £50.
You agree to indemnify us against claims, losses and reasonable costs arising from your misuse of the Service or breach of these Terms, to the extent permitted by law.
We may suspend or terminate access if you breach these Terms or to protect the Service or other users. You may stop using the Service and delete your account at any time (Settings → Delete account). Sections that by their nature should survive termination (e.g. 3, 4, 5, 11, 12, 13, 16) continue to apply.
We may update the Service and these Terms from time to time. We will post the updated Terms with a new "last updated" date; continued use after changes take effect means you accept them.
Where you obtained the app via the Apple App Store, you acknowledge that: these Terms are between you and TCGradar only, not Apple, and Apple is not responsible for the app or its content; Apple has no obligation to provide maintenance or support; in the event the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (where applicable), and to the maximum extent permitted by law Apple has no other warranty obligation; Apple is not responsible for addressing any claims relating to the app (including product-liability, legal/regulatory or intellectual-property claims); and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to relevant embargoes and are not on any prohibited-parties list.
These Terms and any dispute relating to them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that if you are a consumer resident elsewhere in the UK you retain the protection of, and may bring proceedings in, your local jurisdiction.
